It seems that the Government wants to extract the $5.5 million fine awarded
by the Federal Court against Clarity1 Pty Ltd ($4.5 million) and myself ($1
million). The corporate regulator contacted me last Monday “You have been
chosen by the “Solvency Team” to be subject to the requirement of proving
your Solvency” said the polite public servant on the other end of the
phone.
With a fine 5 times the company’s turnover and 45 times it
previous years profit it is pretty obvious that if the Government
presses for payment, that’s the end of Clarity1. And even though the
judgment against me included an explanation by Justice Nicholson that
there was little possibility that the company (or myself for that
matter) had the capacity to pay, it seems a warning is not enough for
the regulators – they want blood too!
So, it would seem that Carty1 will provide work for the accountancy
professionals – the liquidators.
And I will be left to negotiate the payment the $1 million fine against me.

But it is all a state of mind... so I have been looking for inspiration
wherever it can be found. And in Donald Trumps new book Trump 101 he
comments that the reader maybe aware of his brush with debt 10 or so years
ago. He says that he could have “curled up and hid in a corner” or used the
situation to inspire he to rise to greatness. He chose the second course,
and took the temporary situation as being a challenge and opportunity.
History shows that he recovered and has prospered.
He comments “At the time I was $9 BILLION is debt…”
Well, what’s a paltry $1 million compared to that! So that’s the new
challenge. Let’s get on with it and create a more vibrant business that
educates future business leaders here, in New Zealand, Asia and Europe.

P.S. Did you
know that whilst we have laws for bad people, some people make it really easy
for the authorities. A woman was reporting her car as stolen, and mentioned that
there was a car phone in it. The policeman taking the report called the phone
and told the guy that answered that he had read the ad in the newspaper and
wanted to buy the car. They arranged to meet, and the thief was arrested
P.P.S. Here are a number of laws that made on the statute books in the
US.. No person may water his lawn in such a way as to annoy his or her neighbour
- Cussing over the telephone is against the law - You cannot sell the clothes
you are wearing to pay off a gambling debt - Citizens must honk their horn while
passing other cars - Women may not wear heels over 3 inches in length while on
the common - Clothes may not be hung to dry on Sunday - A license is required to
keep a lunatic.

I missed you - I hope that makes you feel better - after your Brisbane Holiday
Inn experience, it should.
Sadly, your experience is just part of an epidemic that the whole of
Australia suffers from - and its getting worse !
Just 2 weeks ago, my wife was admitted into one of Sydney's so called "Top
Hospitals' for a hip rereplacement operation. (the extra re because it
was done the first time 30 years ago and quite literally wore out.) The surgeon
was fine - courteous, competent and caring but that did not spread outside the
operating theatre. The Hospital is very well equipped and relatively new but the
nursing and cleaning care are almost non-existent. It is now very much a case of
DIY beyond the routine BP & Pulse readings and the regular supply of pills and
potions.
No "how are - how do you feel" enquiries. Push the call bell and during the day
you can wait anything up to half an hour or more and in the night - no response
at all unless your other room patient calls out for you and keeps the pressure
on the bell. TV is supplied but the reception is very bad and enquiries reveal
that "there doesn't seem to be anything we can do about that" As for the so
called 'cleaning' staff - no wonder most hospitals suffer from infection
problems.
I could, and probably should, report the casual approach to the authorities, but
I have since found out that it would be a waste of time.
Nobody really cares. Amazing isn't it.
Obviously you don't appreciate how lucky you were to ultimately get an
apology - the word has almost become obsolete.

Hi Wayne,
My son Andrew works as a night receptionist due to uni commitments. He left
his employ largely because of a situation at his hotel where the guest was
treated less than professionally and naturally complained bitterly but the hotel
did not back up Andrew when he tried to intervene and instead blamed the guest!
(Andrew was the one expected to report the incident even though it happened
elsewhere in the hotel - the guest wanted room service which got botched. When
Andrew tried to introduce some logic and apology he was chastised! The whole
fiasco took hours instead of minutes - just as in your absurd case)
Anyhow he's now working at a 5 star hotel in the city. This situation was final
straw time for him. Thought I'd add my story to yours. I've also sent it on to
him. Thanks.

Wayne, re making yourself uncomfortable. You may not have fought a bull a la
Spain, but you you have fought our noble Government bureaucrats, and that's one
hell of a bull. And you may have not won the first round, but it has certainly
made you a stronger man - at least in my eyes.
I think it has also sorted out your true friends, but maybe that's another story
